Short version: Polaris characters are digital collectibles on Ethereum. You hold your own keys, blockchain transactions are final, and nothing on this site is financial advice or a promise of value.

1. Scope

These Terms of Use govern your access to the website at polarisforms.xyz (the "Site") and your use of any content, artwork, metadata or smart contract made available through it. By using the Site you agree to these Terms. If you do not agree, do not use the Site.

The Site is an informational page for Polaris, a collection of computer-generated characters recorded on the Ethereum blockchain. The Site does not hold your assets, does not custody wallets and does not process payments on your behalf.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, and legally able to enter into a binding contract. You must not be located in, or a resident of, a jurisdiction where access to digital assets is prohibited, and you must not be subject to sanctions administered by any recognised authority.

You are responsible for making sure your use of the Site and of any Polaris character complies with the law that applies to you.

3. The characters

Each Polaris character is a non-fungible token on Ethereum. The character is generated by the smart contract and returned when the token's metadata is read, which means the artwork does not depend on a separate image host staying online. Ownership of a token is recorded on the Ethereum blockchain and is governed by the contract, not by this Site.

We do not represent that any character has, or will have, any particular market value, utility, rarity or resale price. Supply, price, mint timing and any future features may change or may never ship.

4. Your wallet

You access the blockchain with your own wallet. You are solely responsible for your keys, your devices and your approvals. We never ask for your seed phrase or private key, and anyone who does is not us.

  • Blockchain transactions are irreversible. A mistaken address, a wrong network or an unwanted approval cannot be undone by us.
  • Network fees are set by the network, not by us, and are not refundable.
  • You are responsible for reviewing any contract interaction before you sign it.

5. Holder licence

While you own a Polaris token, you are granted a worldwide, non-exclusive, royalty-free licence to display, reproduce, and create derivative works of the character associated with that token, including for commercial purposes, subject to the limits below. The licence ends when you transfer the token, at which point it passes to the new owner.

The licence does not allow you to:

  • use the Polaris name, wordmark, star mark or site design as your own brand, or register them as a trademark;
  • claim to be Polaris, its team, or an official representative;
  • create a competing collection that reuses the character's artwork;
  • use the character in material that is unlawful, defamatory, hateful, or that sexualises minors.

We may use images of the collection, including characters you own, to promote Polaris.

6. Risk and no advice

Digital assets are volatile and can lose all value. Smart contracts can contain bugs. Marketplaces can freeze listings. You accept these risks entirely.

Nothing on the Site is financial, investment, legal, accounting or tax advice, and nothing is an offer to sell or a solicitation to buy any security or financial instrument. We do not promise any return, roadmap delivery, liquidity, or secondary market.

7. Taxes

You are responsible for any tax that arises from acquiring, holding or disposing of a Polaris character in your jurisdiction. We do not provide tax reporting.

8. Prohibited conduct

  • Impersonating Polaris, its team, or another collector.
  • Running giveaways, airdrops or "support" channels in our name.
  • Attempting to exploit, drain, or interfere with the contract or the Site.
  • Scraping the Site at a volume that degrades it for others, or bypassing technical protections.
  • Using the Site where it would breach sanctions or export controls.

9. Third parties

The Site links to X and may be read by wallets, marketplaces and explorers that we do not control. Their terms and privacy practices apply to your use of them. We are not responsible for third-party content, listings, prices or outages.

10. Site ownership

The Site, its text, layout, code and the Polaris name and star mark are owned by the project and protected by intellectual property law. Nothing in these Terms transfers those rights to you.

11. Disclaimers and limitation of liability

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, data, tokens or opportunity, arising from your use of the Site, the contract or any third-party service. Where liability cannot be excluded, it is limited to the amount you paid us to use the Site, which is zero.

12. Changes

We may update these Terms, the Site, or the collection at any time. The "last updated" date above shows the current version. Continued use of the Site after a change means you accept the updated Terms. We may also suspend or discontinue the Site.

13. Governing law and disputes

These Terms are governed by the laws of [JURISDICTION TO BE CONFIRMED], without regard to conflict of law rules. Disputes will be brought before the courts of that jurisdiction, unless mandatory consumer law where you live says otherwise. Before starting proceedings, contact us and allow 30 days to resolve the issue.
